Terms of Service

By creating an EMRDoctor account, provisioning a clinic on EMRDoctor, or using the software in any capacity — as a doctor, nurse, receptionist, administrator, or in any other role — you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the software.

These terms constitute a binding agreement between you (and the clinic or hospital you represent) and EMRDoctor.

EMRDoctor is a software tool for managing patient records, consultations, prescriptions, queue and reception workflows, billing, and related clinical operations. It is a record-keeping and workflow tool, not a medical device, not a diagnostic aid, and not a substitute for clinical judgment.

EMRDoctor is intended for use by licensed medical practitioners, authorised clinic and hospital staff, and their support personnel. By using EMRDoctor you represent that you are legally entitled to practise or support the practice of medicine in your jurisdiction, or that you have the clinic's explicit permission to use its account in your assigned role.

You are responsible for keeping your account credentials confidential. Do not share your password. Do not let another person use your account. Notify us immediately if you suspect unauthorised access.

Clinic administrators are responsible for provisioning and de-provisioning staff accounts promptly, especially when a staff member leaves the clinic.

You agree not to:

• Use EMRDoctor for any purpose that is unlawful in your jurisdiction.
• Attempt to gain unauthorised access to any part of EMRDoctor, any other clinic's data, or any underlying systems.
• Interfere with the operation of EMRDoctor or compromise its security.
• Use EMRDoctor to store data that you do not have the legal right to store, or to record patient information without the appropriate consent required by law.
• Reverse-engineer, decompile, resell, sublicense, or create derivative works of the software without our written permission.

You are fully responsible for what you deliver to your patients using EMRDoctor. EMRDoctor is a tool that records, organises and presents the information you enter. It does not diagnose, prescribe, or make clinical decisions. Clinical judgment — including the choice of diagnosis, the choice of medication, the choice of dose, and every other clinical decision — is yours and yours alone.

You are responsible for verifying prescriptions, dosages, allergies and any other clinical information before providing care. Alerts, warnings and templates surfaced by EMRDoctor are guides, not authoritative clinical judgments.

EMRDoctor is not liable for any medical loss, harm, injury, or other adverse outcome arising from (a) technical failures of the software or underlying infrastructure, including unavailability, latency, data corruption, or software defects; (b) illegal, unauthorised or negligent use of the software by any user; or (c) any clinical decision made by a practitioner based on information viewed, entered or printed through EMRDoctor.

Doctors and other users are advised to use EMRDoctor with due professional responsibility. Continued use of the software constitutes acknowledgement of these responsibilities and acceptance of these terms.

We work to keep EMRDoctor available. We target 99.9% monthly uptime, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance windows, third-party infrastructure incidents, and other events outside our reasonable control may cause the service to be unavailable for periods of time.

If EMRDoctor is unavailable, you must have a fallback for continued patient care (whether that is paper records, another EMR, or another documented process). Your clinical practice cannot depend on any single tool being always available.

To the maximum extent permitted by applicable law, EMRDoctor's aggregate liability to a clinic for any and all claims arising from or related to the use of the software shall not exceed the fees paid by that clinic to EMRDoctor during the twelve months immediately preceding the event giving rise to the claim.

EMRDoctor shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including but not limited to loss of profits, loss of business, loss of goodwill, or loss of anticipated savings, whether or not EMRDoctor has been advised of the possibility of such damages.

EMRDoctor is billed monthly, in advance, from a prepaid wallet balance held for the clinic. Wallet recharges are non-refundable except where required by law. If a clinic stops paying, we stop billing and the service is suspended after a short grace period; clinical records remain retrievable per the retention policy in our Privacy Policy.

You may stop using EMRDoctor at any time; there is no annual lock-in and no exit fee. We may suspend or terminate access to any account that materially breaches these terms, with reasonable notice where practical.

These terms are governed by the laws of India. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in India.

We may update these terms from time to time. Material changes will be communicated to active clinic administrators before they take effect. Continued use of EMRDoctor after the effective date of the updated terms constitutes acceptance of them.
